2.3 Audio, Video, and Visual Data

Our AI-powered interview technology collects both audio AND video data during interviews. By participating in an interview, you consent to the recording of your voice and image.

Our Service uses AI-powered voice and video interview technology. We collect and process:

  • Voice recordings of interview responses
  • Video recordings of interview sessions (webcam footage)
  • Profile images/photographs captured automatically during the interview
  • Transcriptions of spoken words
  • Voice characteristics (pitch, tone, cadence)
  • Visual appearance and facial imagery
  • Audio and video quality metrics and timestamps

These recordings are processed using artificial intelligence to generate competency assessments and hiring recommendations. Audio and video data may be retained for quality assurance, compliance, AI model training, and Service improvement.

2.4 Assessment Data

The AI system generates:

  • Competency scores and performance ratings
  • Strengths and improvement areas
  • Risk and behavioral assessments
  • Hiring recommendations

2.5 Technical Data

We automatically collect:

  • IP addresses, browser type, device data

4. Information Sharing

  • With Employers: Candidate data, AI assessments, interview video recordings, profile images, and audio transcriptions are shared with employers conducting interviews through our platform.
  • With Service Providers: Hosting, analytics, database, cloud storage (including AWS S3), and email delivery providers assist in operating the Service.
  • With Legal Authorities: To comply with laws, legal processes, or government requests.
  • For Business Transfers: In mergers, acquisitions, or sales of assets.
  • With Consent: When you provide explicit consent.

Employer Misuse and Data Processing Role

Once candidate data, video recordings, or assessments are shared with an employer, Vesta AI acts as a data processor on behalf of that employer. Employers are solely responsible for complying with employment, privacy, and anti-discrimination laws. Vesta AI may suspend or terminate access for misuse of candidate data.

5. Data Retention

  • Account Info: Retained during account life + up to 7 years.
  • Interview Video Recordings: Retained for at least 3 years; may be kept indefinitely for AI training and quality assurance.
  • Interview Audio Data: Retained for at least 3 years; may be kept indefinitely for AI training and quality assurance.
  • Profile Images: Retained for at least 3 years; may be kept indefinitely.
  • Resume Data: Retained for the duration of job postings + up to 5 years.
  • Communications: Up to 7 years.
  • Technical Data: Up to 2 years.

6. Your Rights

You may:

  • Request access, correction, or deletion of your information (including video and audio recordings)
  • Request data portability
  • Object to certain processing
  • Opt out of marketing communications
  • Decline to participate in video-recorded interviews (note: this may affect your application)

7. Security

We maintain administrative, technical, and physical safeguards consistent with industry standards, including encryption, role-based access control, secure cloud storage (AWS S3), and regular security reviews.

Limitation of Liability for Security Events

While no system is completely secure, Vesta AI shall not be liable for unauthorized access, disclosure, or loss of data except where caused by its gross negligence or willful misconduct.

8. Biometric Data Notice

⚠️ Important Notice Regarding Biometric Data

Our Service collects biometric identifiers and biometric information as defined under various state laws, including voice recordings, voice characteristics, video recordings, facial imagery, and photographs.

8.1 Illinois Residents (BIPA)

Under the Illinois Biometric Information Privacy Act (BIPA), we notify Illinois residents:

  • We collect voice recordings, voice characteristics, video recordings, facial imagery, and photographs (biometric identifiers)
  • Purpose: To conduct AI-powered interviews and generate candidate assessments
  • Retention: At least 3 years; may be kept indefinitely for AI training
  • We will not sell, lease, or trade your biometric data
  • Your biometric data is stored using reasonable security measures
  • You must provide written consent before we collect biometric data

8.2 Texas Residents (CUBI)

Under the Texas Capture or Use of Biometric Identifier Act, we notify Texas residents:

  • We capture biometric identifiers including voice recordings and facial geometry
  • Biometric data is used solely for interview assessment purposes
  • We do not sell, lease, or disclose biometric identifiers except as required by law or with your consent

8.3 Washington Residents

Under Washington's biometric privacy laws, we provide notice that:

  • We collect biometric identifiers for commercial purposes (interview assessments)
  • You are providing consent by participating in an interview after receiving this notice

9. International Data Transfers

Your information, including video and audio recordings, may be transferred to and processed in the United States, Puerto Rico, or other countries.

GDPR Compliance

For users in the European Economic Area (EEA), Vesta AI acts as a data controller for candidate data. Our lawful bases include consent and legitimate interest in providing interview assessment services.

We have appointed an EU representative and implement Standard Contractual Clauses (SCCs) for international transfers.

EU users may exercise GDPR rights under Articles 12–23 and may lodge complaints with a supervisory authority.

When processing data on behalf of employers, Vesta AI acts as a data processor under a Data Processing Addendum (DPA) available upon request.

10. Children's Privacy

The Service is not intended for anyone under 18. We do not knowingly collect data from minors.

11. Cookies

We use cookies and similar technologies for functionality and analytics. You may disable cookies in your browser, though some features may not work properly.
